Siegel Law Group served as lead counsel and obtained a $4,250,000 settlement in this wage and hour lawsuit against Matrix Absence Management, Inc. on behalf of 203 Rule 23 class members who worked as salaried Claims Examiners reporting to Matrix’s Hawthorne, New York office. Led by Jack Siegel of Siegel Law Group, the plaintiffs brought this unpaid overtime case alleging violations of the federal Fair Labor Standards Act, 29 U.S.C. § 201, et seq. (“FLSA”) and New York Labor Law (“NYLL”). The case was litigated in the United States District Court for the Southern District of New York and was captioned Heckle et al. v. Matrix Absence Management, Inc., No. 7:21-cv-01463.
The plaintiffs were Telephonic Claims Examiners who processed disability and leave-of-absence claims under Matrix’s procedures. They alleged that they routinely worked more than forty hours a week, were paid a flat salary, and were classified as exempt without being paid overtime. The court certified a New York Labor Law class on December 14, 2022 (read about the ruling). The settlement resolved the claims alleged in the action.
